Being no expert on this particular case, I do believe it´s the other way around. The Killers came in 1946 and Dragnet in 1951.

No - the dragnet theme came first. Rosza unknowingly used it in this film which caused a lawsuit. Rosza never needed to steal ideas as he was a melodic genius, but simple themes often find their way into different pieces of music without being outright violations of copyright.

The greatest theme from Miklós Rózsa from the 1946 film “the Killers.” The Dragnet composer was at the Miklós Rózsa recording sessions and the Dragnet theme appears after. The lawsuit was made by the original film music publishers and there was a settlement in favor or both composers.

You may be right. I read once that the theme used for both was written before the movie and before the 1949 radio show, but I do not remember exactly where. It was in a history of film music book, I think. Still, the dates you gave make it seem like my source was wrong. Thanks for the enlightenment!
